Please read these Terms and Conditions carefully. They explain the rules, responsibilities, and rights for using PhotoMaster, whether you are a client, freelancer, or service provider.

1. Introduction

PhotoMaster is a creative services marketplace designed to connect clients with photographers, videographers, models, editors, and rental service providers. By accessing or using our platform, you agree to comply with these Terms and Conditions, which govern the use of our services, website, and any related content. The platform aims to provide a secure, reliable, and transparent environment for both clients and freelancers.

By using PhotoMaster, you acknowledge that all profiles, portfolios, and service listings are provided by independent freelancers or service providers. PhotoMaster acts only as a platform facilitating connections and is not responsible for the performance, quality, or legality of any services offered. Clients and freelancers are responsible for communicating clearly, agreeing on terms, and managing payments directly with each other. By continuing to use the platform, you accept these terms and understand your responsibilities as a user of PhotoMaster.

2. Your Use of the Sites

By accessing and using PhotoMaster, you agree to use the platform only for lawful purposes and in accordance with these Terms and Conditions. You must not post, upload, or share any content that is illegal, offensive, fraudulent, or infringes on the rights of others. Users are responsible for maintaining the confidentiality of their account information, including login credentials, and for all activities that occur under their account.

PhotoMaster is intended for connecting clients with creative professionals and facilitating service discovery. You agree not to misuse the platform, interfere with its functionality, or attempt to gain unauthorized access to any part of the site or other users’ accounts. PhotoMaster reserves the right to suspend or terminate accounts that violate these terms or engage in any activity that may harm the platform or its users.

3. Content and Ideas

All content, portfolios, service listings, and ideas shared on PhotoMaster remain the property of the respective freelancer or user who uploaded them. By using the platform, you agree to respect the intellectual property and creative rights of others and not copy, distribute, or use content without explicit permission.

Clients and freelancers are encouraged to share ideas and communicate openly, but PhotoMaster does not claim ownership of any user-generated content. Users are responsible for ensuring that the content they upload or share is original or properly licensed and does not infringe on the rights of any third party.

4. Payments & Fees

PhotoMaster may provide certain services, subscription plans, or features that require payment. By using these paid services, you agree to provide accurate and up-to-date payment information and to pay all applicable fees associated with the service you select. All fees are non-refundable unless otherwise stated or required by law.

PhotoMaster may modify pricing, fees, or payment terms at any time, with notice provided on the platform. Users are responsible for reviewing the current pricing and fee structure before making any payments. Failure to pay for services or subscriptions may result in suspension or termination of access to paid features.

5. Account Responsibilities

Users are responsible for creating accurate and truthful accounts, including providing valid contact information and service details where applicable. Each user is accountable for all activities performed under their account and agrees to maintain the confidentiality of login credentials.

You must not impersonate other users, create multiple accounts to bypass restrictions, or use the platform for fraudulent or harmful purposes. TalentSnap reserves the right to suspend or terminate any account that violates these responsibilities or engages in misconduct.

6. Limitation of Liability

PhotoMaster acts only as a platform connecting clients with freelancers and service providers. We are not responsible for the quality, performance, or legality of any services offered by freelancers or the accuracy of any content uploaded by users.

Users agree that PhotoMaster shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform, including disputes between clients and freelancers. All transactions, communications, and agreements are made at the users’ own discretion and risk.

7. Termination & Suspension

PhotoMaster reserves the right to suspend or terminate your account, access to the platform, or any services at any time, with or without notice, for conduct that violates these Terms and Conditions, applicable laws, or poses a risk to other users or the platform.

Users may also voluntarily terminate their accounts at any time by following the account deletion process on the platform. Termination does not relieve users of any obligations incurred prior to termination, including payment of fees or compliance with intellectual property rights.

8. Privacy & Data Use

PhotoMaster respects your privacy and handles all personal information in accordance with our Privacy Policy. By using the platform, you consent to the collection, storage, and use of data necessary to provide services, facilitate transactions, and improve the user experience.

We will never sell or share your personal data with third parties for marketing purposes without your explicit consent. Users are responsible for maintaining the confidentiality of their own account information and any data shared with other users through the platform.

9. Governing Law & Dispute Resolution

These Terms and Conditions are governed by the laws of Sri Lanka. Any disputes arising from the use of PhotoMaster shall be resolved in accordance with applicable Sri Lankan laws, and users agree to submit to the jurisdiction of Sri Lankan courts for any legal proceedings.

In the event of a dispute between users, PhotoMaster encourages amicable resolution directly between the parties. PhotoMaster may assist in facilitating communication but is not responsible for resolving disputes or enforcing agreements between clients and freelancers.
